A recently enacted California legislation, effective from 2024, aims to enhance safety measures in bars and nightclubs by mandating the availability of drug testing kits for patrons to assess their beverages.

In response to the concerning rise in drink-spiking incidents, California has introduced AB 1013, a law compelling nightlife establishments to provide on-site drug testing kits for patrons to ascertain the integrity of their drinks.

This newly instated law, which garnered unanimous support on the Senate Floor, stipulates that bars and clubs must possess various tools such as test strips, stickers, straws, and other devices designed to identify the presence of controlled substances in a drink. These tests are capable of detecting common date-rape drugs like ketamine, GHB, and flunitrazepam, the lattermost of which is also known as Rohypnol or “roofies.”

Brian Jinings, co-owner of San Diego’s Number One 5th Avenue bar, expressed approval for the legislation, highlighting the challenges of maintaining vigilance in crowded spaces. He welcomed the availability of tools that empower customers and employees to take control and ensure their own safety.
